2. Applicable Conditions

The use of services offered by DEESCO SAS is subject to the following contractual and informative documents:

  • the DEESCO Privacy Policy;
  • the General Terms and Conditions of Sale and Use (CGVU) applicable to the Deesco Pass® platform.

The aforementioned documents are accessible at any time from the sites and platforms operated by DEESCO SAS. In the event of a contradiction between this Legal Notice and the Privacy Policy concerning the protection of personal data, the provisions of the Privacy Policy shall prevail. The General Terms and Conditions of Sale and Use apply exclusively to the services offered via the Deesco Pass® platform.

4. Hosting

The services operated by DEESCO SAS are based on several distinct technical infrastructures. The deesco.com website, the Deesco Pass® platform, and the Deesco Very® platform are hosted and operated according to the following architecture:

DEESCO SAS selects its hosting and infrastructure providers ensuring compliance with applicable security, confidentiality, and personal data protection requirements. Data relating to the Deesco Pass® and Deesco Very® platforms are hosted by specialized providers selected by DEESCO SAS. Certain technical services used for the operation of the website may be provided by international providers subject to appropriate safeguards in accordance with applicable data protection regulations. The technical infrastructures used for the operation of the Services may evolve over time. Users are informed that hosting or technical operation providers may be replaced by DEESCO SAS subject to maintaining an equivalent level of security and compliance.

5. Service Description

5.1 DEESCO

DEESCO is a French company specializing in the development of digital solutions dedicated to the energy performance of residential housing. DEESCO designs, develops, and operates SaaS platforms for individuals, professionals, and institutional players in the energy and renovation sector.

5.2 Deesco Pass

Deesco Pass is a B2C/B2B2C SaaS platform dedicated to the intelligent management of residential energy performance. It offers individuals a personalized digital space enabling:

  • Monitoring of multi-energy consumption (electricity, gas, other energies);
  • Estimation of the home's energy performance via the eDPE by DEESCO® tool;
  • Connection to energy data flows via the ENEDIS (Linky) and GRDF (Gazpar) APIs, subject to the user's explicit consent;
  • Document centralization and a housing digital safe for the secure management of property-related documents;
  • Simulation of energy renovation works, estimation of available financial aid, and financing scenarios;
  • Personalized recommendations for works, smart alerts, and eco-action advice;
  • Simulation and sizing of photovoltaic systems and electric mobility via the Smart Energy module (electric vehicle, charging station);

Deesco Pass is accessible at: https://deescopass.deesco.com/fr as well as in its international versions currently being deployed (English, Spanish, Italian, German).

5.3 Deesco Very

Deesco Very is the B2B solution of the DEESCO ecosystem, accessible at https://deescovery.deesco.com/fr. It is intended for professional partners and companies wishing to access, within a defined contractual framework, certain energy monitoring and analysis functionalities relating to users attached to their commercial or operational scope. The conditions of access to Deesco Very are the subject of specific contracts concluded with DEESCO SA.

6. Intellectual Property and Exclusive Rights

6.1 Ownership of Rights

All the constituent elements of DEESCO's online services including, without limitation, editorial content, graphical interfaces, software architectures, databases, algorithms, energy calculation models, scoring engines, functional workflows, proprietary APIs, software, source code, designs, graphical elements, typography, icons, technical documents, generated reports, recommendations, simulations, and all technical innovations developed by DEESCO are the exclusive property of DEESCO SAS and are protected by the provisions of the French Intellectual Property Code, as well as by applicable international conventions.

6.2 Registered Trademarks

The following trademarks are registered with the National Institute of Industrial Property (INPI) and constitute registered trademarks belonging to DEESCO SAS:

  • DEESCO®
  • Deesco Pass®
  • Deesco Very®
  • eDPE®
  • eDPE by DEESCO®

Any reproduction, imitation, use, affixing, or mention of these trademarks, without the express prior authorization of DEESCO SA, is strictly prohibited and constitutes an infringement likely to engage the civil and criminal liability of its author.

6.3 Protected Technological Assets

The following elements are expressly protected under intellectual property, and may not be subject to any reproduction, exploitation, distribution, representation, adaptation, or use without the prior written consent of DEESCO SAS:

  • The eDPE by DEESCO® tool, its calculation engine, statistical models, and energy estimation algorithms;
  • Energy scoring, recommendation, and work simulation models;
  • Automatic data extraction (OCR), pre-filling, and document analysis systems;
  • Application architectures, databases, data structures, and technical diagrams;
  • Proprietary APIs, their specifications, and integration logic;
  • User interfaces, onboarding journeys, designs, and graphical elements;
  • Processing workflows for energy, documentary, and asset data;
  • Internal technical documentation, functional specifications, and product deliverables.

6.4 Specific Prohibitions

The following are strictly prohibited without the prior written consent of DEESCO SAS:

  • Scraping, crawling, or automated extraction of data, content, or results from DEESCO services;
  • Reverse engineering, decompilation, or any attempt to reconstruct the source code, algorithms, or proprietary models;
  • Reproduction, copying, distribution, marketing, or reuse, in any capacity whatsoever, of the content, interfaces, data, or functionalities of DEESCO services;
  • The use of data from Deesco Pass for commercial purposes, competitive benchmarking, or the development of competing services;
  • Any use of bots, crawlers, or automated scripts intended to access DEESCO services in an unauthorized manner.

7. Nature and Scope of eDPE by DEESCO®

Important Regulatory Warning

The eDPE by DEESCO® is an informative and indicative energy estimation tool. It does not constitute a regulatory Energy Performance Certificate (DPE) within the meaning of articles L. 126-26 and following of the Construction and Housing Code and cannot be used as a substitute. The eDPE by DEESCO® is based on declarative data provided by the user during onboarding and throughout the use of the platform, optionally supplemented by automatically retrieved data (ADEME DPE, ENEDIS data, GRDF data) and proprietary statistical hypotheses.

Consequently, the eDPE by DEESCO®:

  • Has no regulatory, legal, or enforceable value;
  • Cannot be used in the context of a real estate transaction (sale, rental) nor to satisfy any legal or administrative obligation;
  • Does not replace a professional energy audit or a DPE carried out by a certified diagnostician;
  • Does not constitute a guarantee of the home's actual energy performance;
  • May present significant discrepancies with the actual energy performance of the property.

More generally, all simulations, estimations, savings projections, energy scores, work recommendations, and financial evaluations produced by Deesco Pass are purely indicative and do not engage the liability of DEESCO SAS.

8. Limitation of Liability

8.1 Accuracy of Information

DEESCO SAS strives to keep the information published on its services up to date and accurate. However, DEESCO SAS does not guarantee the completeness, accuracy, or error-free nature of the content offered and reserves the right to modify it at any time without notice. The liability of DEESCO SAS cannot be engaged due to errors, omissions, or inaccurate information.

8.2 Service Availability

DEESCO SAS implements a best-efforts obligation to ensure the availability of its services. DEESCO SAS cannot, however, be held responsible for unavailability resulting from:

  • Planned or emergency maintenance operations;
  • Breakdowns or technical failures of the hosting infrastructure;
  • Cybersecurity incidents, cyberattacks, acts of piracy, or unauthorized intrusions;
  • Unavailability or errors of third-party APIs and services (ADEME, ENEDIS, GRDF, partners);
  • Cases of force majeure as defined by Article 1218 of the Civil Code;
  • Server overload or unforeseeable events affecting the technical infrastructure.

8.3 Third-Party Data

Certain functionalities of Deesco Pass rely on data transmitted by third parties (ADEME, ENEDIS, GRDF, energy suppliers, government APIs). DEESCO SAS does not control these data flows and declines all responsibility in the event of error, delay, incompleteness, or unavailability of data from these sources. The results and estimates produced from the user's declarative data remain the sole responsibility of the latter regarding their accuracy.

8.4 Automated Processing and Scoring

The analyses, recommendations, energy scores, and simulations generated automatically by DEESCO's algorithmic engines do not constitute decisions producing legal effects within the meaning of Article 22 of the GDPR. These processes are provided purely for informational and indicative purposes. DEESCO SAS declines all responsibility regarding the decisions made by the user based on these results.

8.5 External Links and Third-Party Services

DEESCO services may contain links to third-party sites or integrate features from partners. DEESCO SAS does not control the content of these sites or services and cannot be held responsible for their availability, content, privacy policy, nor for any damage resulting from viewing or using them.

8.6 User Responsibility

The user is solely responsible for their use of DEESCO services and the information communicated to them. In particular, it is their responsibility to take all appropriate measures to protect their account, login credentials, and personal data against unauthorized access, and to verify the relevance of the information obtained before making any decision.

9. Personal Data and Privacy

DEESCO SAS collects and processes personal data as part of the operation of its services, in compliance with the provisions of the General Data Protection Regulation (GDPR - EU Regulation 2016/679) and the law n° 78-17 of January 6, 1978 relating to computing, files, and freedoms (Data Protection Act), as amended. DEESCO SAS applies the principles of Privacy by Design and Privacy by Default in the design and operation of its services.

9.3 User Rights

Users also have the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL), the competent French supervisory authority.

9.4 Privacy Policy

The collection, processing, and use of personal data are described in detail in the DEESCO SAS Privacy Policy, accessible from each of the online services. The Privacy Policy is an integral part of the contractual documents binding on the user.

10. Cookies and Trackers

The use of cookies and other trackers (purposes, categories, methods of obtaining and withdrawing consent) is described in detail in the DEESCO Privacy Policy and the dedicated Cookie Policy, accessible from all Services. The user can exercise their choices at any time via the consent management platform (CMP) made available to them.

11. Cybersecurity

DEESCO SAS implements reasonable technical and organizational security measures aimed at protecting data and the integrity of its services against unauthorized access, alteration, loss, or disclosure. These measures notably include encryption of communications (HTTPS/TLS), access control, multi-factor authentication for administrator access, logging of security events, and infrastructure monitoring. However, DEESCO SAS cannot guarantee absolute security against all cyber threats and declines all responsibility in the event of damages resulting from an intrusion, cyberattack, or unforeseeable security incident affecting its services or its infrastructure providers. The user is responsible for the security of their own equipment, login credentials, and IT environment. Any suspicion of account compromise must be reported immediately to support@deesco.com.

DEESCO's services are designed to adapt to international distribution. Multilingual versions of the Deesco Pass platform are accessible or currently being deployed at the following addresses:

13. Applicable Law and Jurisdiction

This legal notice is governed by French law. Any dispute relating to their interpretation, validity, or execution falls under the exclusive jurisdiction of the competent French courts, subject to the public policy rules applicable to the user in their capacity as a consumer, in accordance with the provisions of European law and in particular Regulation (EU) No 1215/2012 of December 12, 2012. In the event of a dispute with a consumer, the parties may resort to a mediation procedure. DEESCO SAS adheres to a consumer mediation service in accordance with articles L. 612-1 and following of the Consumer Code.
